The ownership battle over 9mobile has shifted to the Court of Appeal as businessman Alhaji Abubakar Isa challenges the ruling of Justice M. Umar of the Federal High Court, Abuja, which dismissed his suit over the alleged unlawful transfer of 43 million shares in Teleology Nigeria Limited.
Justice Umar had struck out Isa’s case on September 24, 2025, citing lack of locus standi (legal standing), and insufficient proof of ownership or beneficial interest in the disputed shares allegedly held in trust by Seltrix Limited.
In his appeal filed on October 13, Isa, through his counsel Femi Atteh, SAN, argued that the trial court erred in law by dismissing his case without a full hearing.
He maintained that Seltrix Limited still holds the shares in trust for him and that the company’s actions amount to a breach of that trust.
Isa urged the appellate court to overturn the ruling and order a retrial before another judge.
The Federal High Court Registrar has fixed November 5, 2025, for the settlement of the record of appeal in Abuja.
