A Lagos High Court sitting in Ikeja has dismissed the application filed by Joseph Aloba, father of the late singer Ilerioluwa Aloba (popularly known as Mohbad), seeking to nullify the legal advice that cleared Naira Marley and show promoter Sam Larry of involvement in his son’s death.
In her ruling on Wednesday, Justice Taiwo Olatokun upheld the discretionary powers of the Lagos State Attorney General, stating that decisions to prosecute or not are within the AG’s legal authority and cannot be subject to judicial review.
Aloba’s legal counsel, led by Senior Advocate of Nigeria Wahab Shittu, vowed to appeal the ruling, stressing that the family’s objective is to ensure justice, not to witch-hunt individuals.
The suit had named the Attorney General and Director of Public Prosecution (DPP), as respondents, alleging denial of fair hearing and premature clearance of suspects, which they argued undermined the Coroner’s Inquest still in progress.
In response, the state argued that the DPP discharged the individuals based on available evidence, without obligation to consult the Coroner, and that all procedural requirements were followed.
While the court dismissed the suit, the case remains under public scrutiny as the Coroner’s Inquest continues and the Aloba family prepares to appeal.
