The Nigerian Electricity Regulatory Commission (NERC), has officially announced the transfer of regulatory oversight of the electricity market in Abia State to the Abia State Electricity Regulatory Authority (ASERA).
This development was disclosed in a statement posted on NERC’s official X (formerly Twitter) account on Wednesday.
According to the Electricity Act, any state intending to regulate its own electricity market must formally notify NERC and request the transfer of regulatory powers to its state electricity regulator.
The statement noted that the Abia State Government fulfilled all necessary requirements and formally notified NERC of its intention to assume control of the intrastate electricity market.
As a result, the Commission approved the request and issued an order to transfer oversight responsibilities to ASERA.
“In compliance with the amended Constitution of the Federal Republic of Nigeria and the Electricity Act 2023, the Nigerian Electricity Regulatory Commission has issued an order to transfer regulatory oversight of the electricity market in Abia State from the Commission to the Abia State Electricity Regulatory Authority,” the statement read.
A major provision of the order mandates the Enugu Electricity Distribution Company (EEDC) to establish a subsidiary, EEDC SubCo, which will be responsible for the intrastate supply and distribution of electricity in Abia State.
EEDC is required to complete the incorporation of the new company within 60 days from June 25, 2025.
Following its incorporation, EEDC SubCo must apply for and obtain a license from ASERA to operate within the state.
NERC further stated that all necessary transfers outlined in the order must be concluded by December 24, 2025.
