A Makurdi High Court has ordered the reinstatement of Mr. Austin Agada and other elected executives of the Benue State chapter of the All Progressives Congress (APC), whose tenures were dissolved by the party’s National Working Committee (NWC).
Justice Tertsegha Kume ruled in favor of Agada and eight other plaintiffs, who challenged the termination of their tenures without a fair hearing.
The plaintiffs argued that the NWC’s action violated both the APC’s Constitution and the Nigerian Constitution, citing a breach of their right to a fair hearing.
Despite the APC’s defense that the matter was internal and beyond the court’s jurisdiction, Justice Kume dismissed the claim and ruled that the executives’ tenures remain valid until February 2, 2026.
