Court Affirms Jurisdiction in Case Challenging Emir’s Dethronement in Kano

Justice Liman Mohammed of the Federal High Court in Kano has asserted jurisdiction to hear the case brought by Aminu Babba Dan Agundi, a traditional title holder in Kano Emirate, challenging the dethronement of Aminu Ado Bayero as the 15th Emir of Kano by the Kano State government. This ruling, issued on Thursday, paves the way for Bayero to contest the legality of his removal.

The decision follows closely on the heels of a Kano State High Court ordering substituted service on Bayero and four other dethroned Emirs in a related case initiated by the state government.

Justice Mohammed’s ruling signifies a significant development in the ongoing legal battle, which holds profound implications for the leadership of traditional institutions in Kano State. It ensures that Bayero will have the opportunity to present his case before the Federal High Court.

Three weeks ago, the Federal High Court in Kano issued an interim order preventing the Kano State government from enforcing the State’s Emirate Law 2024, which facilitated the removal of Bayero and four other Emirs. Despite this, Bayero has remained at a mini palace, asserting his claim to the Kano throne, even as Muhammadu Sani II was reinstated and appointed as the 16th Emir of Kano by Governor Abba Yusuf.
