The Court of Appeal in Abuja made a significant decision on Wednesday as it annulled the judgment in the appeal filed by Nasarawa State Governor, Abdullahi Sule, challenging the tribunal’s declaration of David Ombugadu, the Peoples Democratic Party candidate, as the winner of the state’s governorship election.

The original tribunal, led by Justice Ezekiel Ajayi, delivered a split judgment, asserting that Ombugadu secured more valid votes based on evidence from various polling units.

Governor Sule promptly appealed the decision, urging the appellate court to overturn the tribunal’s judgment. In the hearing on Wednesday, counsel for the governor, Wole Olanipekun SAN, argued that the tribunal had erroneously applied the law in its verdict.

Olanipekun contended that the tribunal’s decision heavily relied on the Bimodal Voter Accreditation System machine presented as evidence, without proper demonstration by either the petitioners or the court.
