The Federal Government emerged triumphant in its protracted legal battle against Process & Industrial Developments (P&ID) Limited in a London court on Monday, October 23, 2023. This landmark verdict, reached after five years of rigorous legal proceedings, marks a pivotal moment as it invalidates the staggering $11 billion arbitration award previously granted to P&ID.

Justice Robin Knowles of the Commercial Courts of England and Wales, delivering the verdict through an email ruling, upheld Nigeria’s argument, citing that the ill-fated gas processing contract had been procured through fraudulent means. The court’s decision resounded as a significant turning point in favor of Nigeria, closing the chapter on this longstanding legal dispute.

This momentous judgment culminated from a protracted legal battle between the Federal Government of Nigeria and Process & Industrial Developments (P&ID) Limited. The ruling not only vindicates Nigeria but also underscores the country’s commitment to upholding the rule of law.

The legal saga between the two parties began in 2010 when P&ID entered into an agreement with Nigeria to construct a gas processing plant in Calabar, Cross River State. However, the contract encountered complications, with P&ID asserting that Nigeria had violated its terms.

In response to these disputes, P&ID initiated legal action and ultimately secured an arbitral award against Nigeria on January 31, 2017, demanding that Nigeria pay $6.6 billion in damages, along with pre- and post-judgment interest at seven percent.

Yet, Nigeria sought an extension of time and relief from sanctions, both of which were granted in September 2020, leading to the reopening of the case for arbitration. Nigeria contended that the gas deal was tainted by bribery and fraud.

The federal government’s legal representatives argued that P&ID officials had engaged in corrupt practices to secure the contract. In contrast, P&ID vehemently denied these allegations and accused the Nigerian government of making baseless claims and conspiratorial theories.

During the March trial, Nigeria maintained that the contract was secured through dishonest means, including bribery and perjury, and thus asserted that the arbitration award, which had escalated to $11 billion due to accrued interests, should be set aside.
