Citing a “lack of sufficient and credible evidence,” Justice Madugu declared Chief Edozie Njoku and the co-defendant, Chukwuma Nwoga, not guilty, ordering their discharge and acquittal. The defence counsel successfully argued that the police failed to meet the burden of proof required by law.<\/p>\n
The court, guided by section 138 of the Evidence Act, emphasized that the prosecution must establish its case beyond a reasonable doubt. Acknowledging the internal disputes within APGA as contributing to the complexity of the case, the court maintained a commitment to a thorough and evidence-based legal process.<\/p>\n
In dissecting the first count, which pertained to criminal conspiracy, the court highlighted the absence of circumstantial evidence linking the defendants to an agreement or conspiracy.
