{"id":79279,"date":"2025-11-24T13:12:03","date_gmt":"2025-11-24T13:12:03","guid":{"rendered":"https:\/\/abujacityjournal.com\/livenews\/?p=79279"},"modified":"2025-11-24T13:12:03","modified_gmt":"2025-11-24T13:12:03","slug":"kanu-family-rejects-court-ruling-alleges-legal-breaches","status":"publish","type":"post","link":"https:\/\/abujacityjournal.com\/livenews\/2025\/11\/24\/kanu-family-rejects-court-ruling-alleges-legal-breaches\/","title":{"rendered":"Kanu Family Rejects Court Ruling, Alleges Legal Breaches"},"content":{"rendered":"<p><strong>By Onyeanya Ebere Immaculata<\/strong><\/p>\n<p>The family of detained IPOB leader, Nnamdi Kanu, has rejected the judgment of Justice James Omotosho of the Federal High Court, Abuja, which sentenced Kanu to life imprisonment.<\/p>\n<p>In a Monday statement signed by Emmanuel Kanu, the family said it disagreed with the ruling, alleging legal violations and constitutional breaches.<\/p>\n<p>They argued that key issues were ignored, including Section 36(12) of the Constitution, Supreme Court decisions on repealed laws, and earlier directives related to previous charges.<\/p>\n<p>The family insisted that constitutional safeguards were not upheld, stressing that no one can be convicted for an offence not defined in a written law in force at the time.<\/p>\n<p>They also faulted the court\u2019s reliance on a transition or savings clause, saying it was inapplicable since the Court of Appeal had discharged and acquitted Kanu, thereby terminating earlier proceedings.<\/p>\n<p>According to them, the fresh charges before Justice Omotosho amounted to \u201ca new case\u201d and could not be revived through any transition clause.
