{"id":56752,"date":"2024-11-22T15:01:31","date_gmt":"2024-11-22T15:01:31","guid":{"rendered":"https:\/\/abujacityjournal.com\/livenews\/?p=56752"},"modified":"2024-11-22T15:01:31","modified_gmt":"2024-11-22T15:01:31","slug":"probe-gov-alia-loses-case-against-ortom","status":"publish","type":"post","link":"https:\/\/abujacityjournal.com\/livenews\/2024\/11\/22\/probe-gov-alia-loses-case-against-ortom\/","title":{"rendered":"Probe: Gov Alia Loses Case Against Ortom"},"content":{"rendered":"<p><strong>By Samson Adeyanju\u00a0<\/strong><\/p>\n<p>The Court of Appeal, Makurdi Division, has overturned a Benue High Court ruling that dismissed former Governor Samuel Ortom\u2019s case against the probe panels established by Governor Hyacinth Alia.<\/p>\n<p>Governor Alia had set up panels to investigate state finances and assets under Ortom\u2019s administration from 2015 to 2023.<\/p>\n<p>Ortom challenged the legality of the probes, arguing that the state\u2019s Auditor General had already reviewed the accounts and submitted findings to the State Assembly.<\/p>\n<p>He also claimed the Economic and Financial Crimes Commission (EFCC) was already handling similar investigations, making Alia\u2019s probes a case of double jeopardy.<\/p>\n<p>After the High Court dismissed the suit for being filed late, Ortom\u2019s legal team, led by Oba Maduabuchi, SAN, appealed, asserting that the Public Officers Protection Law cited in the lower court\u2019s ruling was inapplicable to judicial reviews.<\/p>\n<p>The Appeal Court, led by Justice Biobele Abraham Georgewill, unanimously set aside the High Court\u2019s decision, directing the Benue Chief Judge to reassign the case for proper hearing.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>By Samson Adeyanju\u00a0 The Court of Appeal, Makurdi Division, has overturned a Benue High Court ruling that dismissed former Governor Samuel Ortom\u2019s case against the probe panels established by Governor Hyacinth Alia.
