The Court of Appeal in Abuja has nullified the orders issued by Justice Inyang Ekwo of the Federal High Court, Abuja, which barred three prominent chieftains of the Peoples Democratic Party (PDP) from attending meetings of the party\u2019s National Executive Committee (NEC) or participating in any deliberations or proceedings.<\/p>\n
The PDP chieftains affected by the initial order were the party\u2019s former National Chairman, Uche Secondus; former Rivers State Governor, Celestine Omehia; and a former Deputy Speaker of the House of Representatives, Austin Opara.<\/p>\n
In three separate judgments delivered on Friday, a three-member panel of the Court of Appeal unanimously ruled in favor of Secondus, Omehia, and Opara, finding their appeals to be meritorious. The court emphasized that the issues regarding whether members of a political party should attend the party\u2019s meetings or participate in any of its activities are matters to be resolved internally by the party itself, not by the judiciary.<\/p>\n
The appellate court held that disputes related to the internal affairs of a political party, including attendance at party meetings, are not justiciable and fall outside the jurisdiction of the courts. The judges concluded that the Federal High Court erred in entertaining the cases, as they were beyond its jurisdiction.<\/p>\n
Furthermore, the Court of Appeal declared the entire proceedings conducted in the three cases before the Federal High Court null and void, including the ex-parte restraining orders issued by Justice Ekwo on April 5.
