The Federal High Court in Abuja reinstated Rt. Hon. Philip Shaibu as Edo State’s Deputy Governor this morning, following his impeachment by the Edo State House of Assembly. Justice Omotosho held that the impeachment process breached the provisions outlined in Section 188(1) to (9) of the Nigerian Constitution. He emphasized that the ouster clause in Section 188(10), which limits judicial review, is not an isolated provision and must be interpreted in the context of procedural fairness and constitutional compliance. The court referred to the landmark decision of the Nigerian Supreme Court in Inakoju v. Adeleke (2007) to support its ruling.<\/p>\n
The court ordered the 1st Defendant, the Inspector General of Police, to immediately restore the security details of Shaibu as the Deputy Governor of Edo State. At the time of this report, Shaibu\u2019s supporters were seen celebrating the court verdict within the court premises.<\/p>\n
Justice Omotosho further noted that the impeachment was politically motivated due to Shaibu\u2019s aspirations to contest the office of Governor of Edo State. This ruling underscores the importance of adhering to constitutional procedures and ensuring that political processes are not abused for personal or partisan gains.<\/p>\n
