Judge Beryl Howell dismissed the application on Monday.

The suit was originally filed by Aaron Greenspan, an American citizen, in June under the Freedom of Information Act (FOIA). His lawsuit was aimed at several U.S. law enforcement agencies, including the Executive Office for U.S. Attorneys, Department of State, Federal Bureau of Investigation (FBI), Internal Revenue Service, Drug Enforcement Administration, and the Central Intelligence Agency (CIA).

Mr. Greenspan’s complaint alleged that these agencies had violated the FOIA by not releasing documents related to alleged federal investigations into President Tinubu and Mueez Adegboyega Akande, who has since passed away. The records being sought were linked to the Northern District of Illinois and/or Northern District of Indiana and involved charging decisions against Mr. Tinubu and Mr. Akande.

The case stems from a 1993 incident where Mr. Tinubu forfeited $460,000 to the U.S. government due to allegations that the funds were tied to narcotics trafficking proceeds. This issue gained prominence during the Presidential Election Petition Court proceedings when Atiku Abubakar and Peter Obi challenged President Tinubu’s eligibility to run for Nigeria’s presidency.

However, the election court, in a unanimous decision on September 6, dismissed the suits, affirming President Tinubu’s election. As the Nigerian Supreme Court was set to hear Atiku Abubakar’s case against President Tinubu’s election, Mr. Greenspan sought the U.S. court’s intervention to compel the FBI, CIA, and other agencies to expedite the release of documents related to the Nigerian leader. The case in Nigeria continues to be a matter of significant interest and legal contention.

The United States District Court for the District of Columbia has declined an emergency application that sought to compel top U.S. law enforcement agencies to expedite the release of confidential information concerning President Bola Tinubu.
