{"id":34138,"date":"2024-06-07T12:49:42","date_gmt":"2024-06-07T12:49:42","guid":{"rendered":"https:\/\/abujacityjournal.com\/livenews\/?p=34138"},"modified":"2024-06-07T12:49:42","modified_gmt":"2024-06-07T12:49:42","slug":"just-in-tribunal-ruled-for-multichoice-to-give-nigerians-one-month-free-subscription","status":"publish","type":"post","link":"https:\/\/abujacityjournal.com\/livenews\/2024\/06\/07\/just-in-tribunal-ruled-for-multichoice-to-give-nigerians-one-month-free-subscription\/","title":{"rendered":"Just In: Tribunal Ruled For Multichoice to Give Nigerians One-Month Free Subscription"},"content":{"rendered":"<p>The Competition and Consumer Protection Tribunal fined Multichoice Nigeria N150 million for challenging the court\u2019s jurisdiction and ordered the company to provide Nigerians with a one-month free subscription on DStv and GOtv.<\/p>\n<p>The tribunal had previously restrained Multichoice from increasing subscription fees without adequate notice, following a suit by Barrister Festus Onifade who argued that the 8-day notice given by Multichoice for a price hike was insufficient.<\/p>\n<p>Multichoice\u2019s lawyer argued that price regulation disputes had been settled before and should not be re-litigated, while Onifade emphasized the lack of proper notice rather than the price hike itself, leading the tribunal to assert its jurisdiction and rule against Multichoice.<\/p>\n<p><span data-contrast=\"none\">Onifade previously sued Multi-Choice Nigeria Ltd and the Federal Competition and Consumer Protection Commission\u202f(FCCPC),<\/span> accusing the Pay TV of unjustly increasing subscription fees without one-month notice to customers and leveraging on it to seek interim orders against the Pay TV.<span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p>A three-member tribunal chaired by Saratu Shafii had ruled in favour of Onifade by restraining Multichoice in the suit marked\u00a0<strong style=\"font-style: inherit;\"><em>CCPT\/OP\/2\/2024,<\/em><\/strong>\u00a0from going ahead with the impending price increase scheduled to take effect from 1st May 2024 pending the hearing and determination of the Motion on Notice.<span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span> But Multichoice\u2019s lawyer, Moyosore .J. Onibanjo (SAN) filed a preliminary objection urging the court to decline jurisdiction on the suit filed by Festus Onifade and strike it out because such a price dispute case had been decided before in favour of his client.<span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p>Onibanjo also tendered and adopted the previous judgement of the tribunal in\u00a0<strong style=\"font-style: inherit;\"><em>suit no CCPT\/OP\/1\/2022(Exhibit A),<\/em><\/strong><em>\u00a0<\/em>alongside his application, saying when a court has determined an issue between the same parties on the same subject matter before, that matter cannot be re-litigated again by any tribunal or court.<span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p>He stressed that the power to regulate prices is vested in the president of Nigeria, adding that the Tribunal is not the forum where the claimant can come to seek to regulate the prices and services offered by Multichoice.<span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">On his part, Onifade argued that the issue he placed before the court is\u202f whether Multichoice Nigeria gave adequate notice in respect of the May 1, 2024 price TV subscription increase, and not price regulation or increase.\u00a0<\/span><\/p>\n<p><em style=\"font-weight: inherit;\">\u201cIt is our submission that the 8-day notice issued by Multichoice Nigeria\u202f is insufficient in law. A monthly subscriber should be given at least a month.\u00a0<\/em><\/p>\n<p><em style=\"font-weight: inherit;\">\u201cDismiss this application (by Multichoice)<\/em> <em>for being a waste of time of the court,\u201d Onifade prayed.\u00a0<\/em><\/p>\n<p><span data-contrast=\"none\">Onifade also asked the Tribunal to direct Multi-choice Nigeria Limited to pay the sum of N1,000,000,000.00 (One Billion Naira only) or any amount the Tribunal deem may fit appropriate in this circumstance for \u201cdeliberately disobeying, contravening, and failure<\/span> or comply with the Interim Order of this Honourable Tribunal granted on the 29th April 2024.\u201d<span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p>Counsel for the FCCPC, Nikiomari Abeke,\u202f told the CCPT that he was not opposing the application of Multichoice Nigeria but would abide by the direction of the tribunal regarding all the processes before it.<span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<h4>The Ruling<strong>\u00a0<\/strong><\/h4>\n<p><span data-contrast=\"none\">On Friday, the three-man panel chaired by Justice Thomas Okosu held that Section 39(2) of the FCCPC Act states that the tribunal shall have jurisdiction throughout the federation and on all commercial activities aimed at making a profit.\u00a0<\/span><\/p>\n<p><em>\u201cThe jurisdiction of this tribunal extends to all business activities within Nigeria,\u201d Okosu said.\u00a0<\/em><\/p>\n<p><span data-contrast=\"none\">He said he looked at relevant provisions cited by parties and did not find where an aggrieved consumer who seeks to enforce his rights is required to file a complaint to the President of Nigeria or the Price Control Board.\u00a0<\/span><\/p>\n<p>The judge also noted that the claimant wrote letters to the FCCPC before filing his case.<span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><em style=\"font-weight: inherit;\">\u201cI have come to the conclusion that this tribunal has the jurisdiction to preside over consumer rights as in the instant case and I resolve this issue against Multichoice,\u201d the judge said.\u00a0<\/em><\/p>\n<p><span data-contrast=\"none\">Besides, the tribunal held that the claimant\u2019s instant suit is not questioning the Multichoice price hike as claimed by Onibanjo but the illegality of his client\u2019s 8-days\u2019 notice to the customers.\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The Tribunal noted that Multichoice has already disobeyed its interim orders, adding that its action of hiking DSTV and GOTV prices is condemnable and must not be condoned by the Tribunal.\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The tribunal dismissed Multichoice\u2019s preliminary objection for disobeying its interim orders.\u00a0<\/span><\/p>\n<p>Subsequently, the Tribunal imposed an administrative penalty on Multichoice for failing to comply with an order of the tribunal\u00a0<span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><em style=\"font-weight: inherit;\">\u201cThe first defendant is hereby mandated to pay N150 million penalty.\u00a0<\/em><\/p>\n<p><em style=\"font-weight: inherit;\">\u201cMultichoice is hereby ordered to give Nigerians one month free subscription.\u201d\u00a0<\/em><\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Competition and Consumer Protection Tribunal fined Multichoice Nigeria N150 million for challenging the court\u2019s jurisdiction and ordered the company to provide Nigerians with a one-month free subscription on DStv and GOtv.
