{"id":33396,"date":"2024-06-02T19:14:55","date_gmt":"2024-06-02T19:14:55","guid":{"rendered":"https:\/\/abujacityjournal.com\/livenews\/?p=33396"},"modified":"2024-06-02T19:14:55","modified_gmt":"2024-06-02T19:14:55","slug":"fagbemi-urges-labour-to-resume-negotiations","status":"publish","type":"post","link":"https:\/\/abujacityjournal.com\/livenews\/2024\/06\/02\/fagbemi-urges-labour-to-resume-negotiations\/","title":{"rendered":"Fagbemi Urges Labour to Resume Negotiations"},"content":{"rendered":"<p>The Attorney General of the Federation (AGF) and Minister of Justice, Prince Lateef Fagbemi (SAN), has urged organized labour to reconsider their planned nationwide strike, set to begin on Monday, June 3.<\/p>\n<p>Fagbemi described the strike proposed by the Nigeria Labour Congress (NLC) and the Trade Union Congress (TUC) as &#8220;premature&#8221; and advised labour leaders to return to the negotiation table with federal and state governments, and other employers, to avoid unnecessary hardship for Nigerians.<\/p>\n<p>In a letter dated June 1 to the presidents of NLC and TUC, Fagbemi noted that the declaration of a strike action comes while negotiations on a new national minimum wage are still ongoing. He emphasized the importance of considering the interests and capacities of all employers, including the Organized Private Sector.<\/p>\n<p>Fagbemi highlighted that the labour organizations had not issued the mandatory 15-day strike notices required by Sections 41(1) and 42(1) of the Trade Disputes Act 2004. He argued that failing to comply with this requirement makes the strike action illegitimate and unlawful, as the law criminalizes non-compliance.<\/p>\n<p>The AGF also pointed out that the proposed strike contradicts an order from the National Industrial Court (NIC) and ongoing mediation efforts. He questioned the legality of the strike under Section 18(1)(a) of the Trade Disputes Act 2004 and Section 31(6) of the Trade Unions Act.<\/p>\n<p>Referencing the International Labour Organization (ILO) principles, Fagbemi stressed the necessity of prior notice, conciliation, mediation, and arbitration before declaring a strike. He contended that the labour organizations\u2019 ultimatum to the government did not meet the requirement for a formal strike notice.<\/p>\n<p>Fagbemi assured that the government remains committed to resolving issues through collective bargaining and urged labour leaders to return to negotiation meetings.
