The Federal High Court in Abuja, presided over by Justice Binta Fatimat Nyako, is scheduled to issue a critical verdict in the afternoon.<\/p>\n<p>Kanu&#8217;s legal team, headed by Aloy Ejimakor, presented their arguments for bail restoration shortly after the court scheduled the decision for May 27. The federal government&#8217;s case was argued by Adegboyega Awomolo (SAN).<\/p>\n<p>In his motion, Kanu contended that he did not breach bail conditions granted in 2017. Instead, he argued that his flight from the country was necessary to save his life following a military raid on his residence. Kanu accused the federal government of misleading the court, resulting in the revocation of his bail in his absence. He further requested the court to rescind the arrest warrant issued against him while he was abroad.<\/p>\n<p>Additionally, Kanu&#8217;s legal team filed a motion seeking his transfer from the custody of the Department of State Services (DSS) to either house arrest or prison. They stressed the importance of unrestricted access to his lawyers to adequately prepare for his defense against terrorism charges. Citing Section 36 of the 1999 Constitution, they argued that without meeting these conditions, Kanu could not be expected to participate in the trial.<\/p>\n<p>However, the federal government&#8217;s counsel, led by Adegboyega Awomolo, opposed Kanu\u2019s requests. Awomolo asserted that in criminal proceedings, the defendant cannot dictate terms to the court. He emphasized that Kanu had previously breached his bail by fleeing the country under false pretenses. Awomolo argued that Kanu\u2019s new bail application constituted a gross abuse of court process, suggesting that Kanu&#8217;s recourse should be to appeal the bail rejection rather than request the High Court to reconsider its decision. Furthermore, he maintained that DSS custody was the safest place for Kanu.<\/p>\n<p>Awomolo dismissed allegations that Kanu&#8217;s access to his lawyers was being hindered, noting that Kanu\u2019s claims lacked specific evidence or names of DSS operatives involved in any misconduct.<\/p>\n<p>Meanwhile, the Igbos in diaspora have reaffirmed their call for justice and fairness in Kanu\u2019s trial. Operating under the American Veterans of Igbo Descent (AVID), the group urged Justice Nyako to adhere to the principles of equity and the rule of law.
