In a move to address the challenges posed by digital communication, the NBC is seeking to repeal and reenact the existing NBC Act, CAP L11, which dates back to 2004.

During a meeting with Information Minister Mohammed Idris, NBC Director-General Balarabe Ilelah voiced his concerns regarding the current legal framework, which does not grant the NBC the authority to oversee social media platforms. Ilelah described social media’s influence as a “monster” and highlighted the need for legislative measures to address its impact.

He stated, “We want to tell you that a bill for an act to repeal and amend the National Broadcasting Commission (NBC) act, CAP L11 laws of the federation of Nigeria 2004, to accommodate the transition from analogue to digital broadcasting service, also to promote quality audio and video, efficient management of the spectrum, Nigeria Broadcast Institute, social media regulation, and related matters has been read for the first time on the floor of the national assembly.”

The current NBC Act does not address the issues raised by the rapid evolution of the media landscape. In an effort to address these challenges, the NBC has submitted the bill to amend the act.

Ilelah emphasized the growing importance of regulating social media issues, stating, “One of our major problems now is social media. Unless there is a law that allows NBC to act on social media issues, the issue will continue to be a monster in our daily lives in this country.”

The director-general noted that the NBC already has the authority to penalize broadcasters in line with its existing legal framework, which derives its powers from the NBC Act. However, he expressed a preference for negotiation and cooperation with broadcasters rather than punitive measures.

“We have powers, we derive our powers from the act, and we have the powers to sanction stations. We don’t want to sanction; we prefer to bring them together for negotiation, for understanding,” Ilelah explained. “We only apply sanctions when there is no way out of it. We don’t want the stations or the stakeholders to see NBC as an enemy.”

The Information Minister, Mohammed Idris, urged the NBC to work collaboratively with the media to ensure a more constructive approach rather than a punitive one, fostering a spirit of cooperation and understanding among all stakeholders.

Uchendu Alexis The National Broadcasting Commission (NBC) has announced its submission of a bill aimed at regulating social media to the National Assembly.
