The Presidential Election Petitions Tribunal (PEPT) has dismissed Labour Party presidential candidate Peter Obi’s claim for a mandatory 25% vote threshold in the Federal Capital Territory (FCT) as a requirement to win a presidential election victory as ridiculous.<\/p>\n

Justice Haruna Tsammani, who delivered the main judgement in the petition filed by Mr Obi and the Labour Party against President Bola Ahmed Tinubu’s victory in the 2023 elections, stated that scoring 25% was not constitutionally required.<\/p>\n
<\/p>\n
Tsammani claims that the petitioner’s interpretation of Section 134 (2) (b) of the 1999 Constitution was based on a concentration on the term “and,” and that “this is completely fallacious, if not outright ridiculous.”<\/p>\n
<\/p>\n
“The futility and hollowness in the arguments of the petitioners that the votes of the voters in the FCT have more weight than others in other parts of the country to the extent that their votes purportedly have a greater effect on other votes is null and void,\u201d the court held.<\/p>\n
<\/p>\n
Obi and the Labour Party (LP) argued that gaining 25% of the vote in the FCT, in addition to completing other qualifications, was required to be considered the winner of a presidential election.<\/p>\n
<\/p>\n
Obi’s petition against the winner was dismissed.<\/p>\n
