The five-member panel of the apex court, led by Justice Kudirat Kekere-Ekun, made this decision on Friday following final submissions from the federal government’s lawyer, Tijani Gazali (SAN), and Kanu’s counsel, Mike Ozekhome (SAN), on October 5.<\/p>\n
The federal government is seeking to overturn a previous judgment by the Court of Appeal, which dismissed the treasonable felony charge against Kanu and ordered his release, citing his unlawful return to the country after jumping bail. On the other hand, Kanu is urging the Supreme Court to uphold the Court of Appeal’s judgment and affirm his discharge and acquittal.<\/p>\n
The Court of Appeal, in its October 13, 2022 judgment, criticized the government’s handling of Kanu’s return to the country, deeming it a violation of rules of engagement and international laws. The court asserted that the government’s actions amounted to self-help, as it failed to follow proper extradition procedures in Kenya and instead resorted to unlawful abduction and rendition.<\/p>\n
Despite the initial discharge and release order by the Court of Appeal, the federal government secured a stay of execution pending the determination of its appeal against the judgment.
